an expired IEP

My son is going into 3rd grade and school starts the 19th. His IEP expired on the 13th, and the school does not have a new meeting scheduled until the 27th. My question to everyone is has anyone else experienced this, and what did you do? They know they are out of compliance, and when I asked them what would or couold happen one of the ladies made the comment that they would get a call from the special ed police! I would just like some input. I might mention he has Autism, ADHD, Anxiety, OCD, and also speech issues. thanks for you help.

Tri-annuals

Tri-annual take place every three years and on or really close to the date of the first IEP..the so called anniversary...Here I will give an example of requesting a date change...Julian's tri-annual was up in June/2008...I requested that it be delayed until the end of Sept/2008...my reason were I wanted the same test done before to be done again, and added that I wanted him to be tested in his language...which at the present time is with the usage of the PEC's system...and I also wanted the evealuating team, in our case is made up of 3 psychs, 1 speechie, 1 OT. and info from his DAN Dr. and Chiropractor...to all be relaxed and open minded, so they could take their time with the evaluations and not be in a hurry to meet any other dead-line but my own...So we shall see just how much progress Julian has made...I pull him out of school right after his previous tri-annual...So far these IEP's have been in Julian's favor...Thank GOD.

In California the term is Out of Compliance...this just means that the state is not to happy when it finds that there are children with IEP's that are over due...State evaluators get very upset when Out of Compliance due process hearings take place...In my case I was always waiving our 10 day notice because I would call IEP's all the time and ours lasted 2 to 3 days...they were marked on everyones calanders and continuing...If you can order the books from Wright's Law and from NOLO's Special Education series they would be of great help to you and everyone else...NOLO's is a very easy and friendly book...Ans Wright's Law on-line courses are a tremendious help and resource for us all...

tri-annuals and Parents Rights!

I just wanted to share that also every three years they do a Tri-annual . This is where the Whole IEP team evals your child even the nurse to update all testing and see the progress of the child. You also as a parent have the right to call a IEP meeeting at any time even if you had one a month ago , this is your right. At the atart of every meeting they should be giving you a copy of your rights and procedure safeguards. If you wish for them go go over them in a IEP meeting thy should for any questions you may have about them.

In preschool, the renewal date falls on the anniversary of the orignal IEP date - sounds like yours might be in November. At the very least, there needs to be a full team meeting and review of goals once per year - twice per year for young children (infants and toddlers). Another meeting can be requested by the parents at any time as well. Once children enter school, there is a transition meeting just before they enter and this becomes there new annual date - so that they have a meeting going into each school year. Deb

AWETISM is right. A ten-day notice is required by law (IDEA) - unless a parent signs a waiver. I would NOT sign a waiver for this meeting. I have seen 1-hour meetings, but never anything shorter. I would state that I am not pleased with this meeting time. Offer to sign an extension to keep his current plan in place until a more suitable meeting time - and make sure the extension is for no more than a month. Then request a real meeitng ASAP. Deb

here in ca you have to receive a 10 day notice of an IEP and sign it that you agree with when , where and who can attend. One time a Special Ed director showed up to my sons that I did not want there and I ased her to leave or I would cancle the meeting. Also you are part of the Team and the time , meeting place and how long the meeting takes place you should be in agreement with. I have never had a IEP meeting shorter then 1 hour and 30 mins and this is even when I un enrolled him. Also here in Ca the whole IEP team has to attend and if they don't I even have to sign a paper in who I am willing to excuse. I would suggest for your protection you wait intill the whole team is able to attend . You have rights and it sounds like she is trying to take advange of those rights. This makes me nervous for you. IEP good for a year

My daughter had her original IEP done in NOv of 2006 and they used it all school year last year. At the end of the school year, we needed some updates, so we used the old one and made a new one. I thought they were good for the school year no matter what the "expiration date" is. Of course my daughter is in preschool, so maybe thats the difference. I am not sure on this one I will ask around and see what kind of answers I get here.

My son's preschool teacher called and said they had planned on doing his IEP in Oct but she just realized that his expires the end of the month so she wants to do a new IEP on Weds. if I could come in 15 mins before schools starts to do it. I said yes but in the back of my mind I am thinking there is no way we can do his IEP in 15 mins. I figure I can see what happens and if I don't like it don't sign it or call another meeting later. We have decided to keep him in his current placement and try reverse inclusion and visits to the typical preschool. What a smarty pants that one lady was, the special ed police, ha ha, NOT!!

Extension....

The current IEP should be extended from the 13th to the 27th. This means that they would need to remain on the current IEP until the meeting. When this happens in Maine, parents sign an extension saying that they agree to the continuation of the current level of services from the expiration date until the meeting date. I would ask them if there is an extension process and even insist on signing something to insure that the plan continues as is for the 2 week period that is currently uncovered. It is always better to be safe and have a plan in place - even if it is an olde and extended plan. Where it is only for 2 weeks, I would not worry too much about the lack of changes - unless you feel that your son's plan needs HUGE changes over what it currently says. Deb

First Time

I have not heard the word expired used befor. With the experience I have had I live in Ca. Here I did not agree with my son IEP for well over a year I only signed the parts I agreeed with and that is what stayed in place. For Sammy I did not agree with placement but agreeded with the services , so the services continued but the placement did not. This was called a "stay Put" Meaning the current IEP stayed in place . Hope that helps .
